El Tribunal Constitucional turco estudia si el partido de Erdogan es constitucional

No había oído nada sobre esta cuestión hasta que me han mandado este post por correo: La hora de la verdad - Se agudiza en Turquía el choque entre el gobierno islamista y la élite laicista:

El Tribunal Constitucional turco ha aceptado estudiar la ilegalización del Partido de la Justicia y el Desarrollo (AKP), el partido en el Gobierno, liderado por el presidente Recep Tayyip Erdogan, por “posible amenaza al laicismo”. La medida partió del fiscal jefe del Tribunal de Apelaciones, Abdurrahman Yalcinkaya, que remitió a mediados de marzo una petición al Tribunal Constitucional para que ilegalizara al partido gobernante. El fiscal Yalcinkaya afirmó entonces que "el AKP se ha convertido en un semillero de actividades contra el laicismo". El TC ha aceptado la demanda y ha abierto un periodo de seis meses para investigar si el AKP puede ser un peligro real para el estado laico. Si así fuera, sería ilegalizado y sus miembros no podrían ejercer ningún tipo de función pública en los próximos años. Ello supondría la destitución del Presidente de la República, Abdulá Gül y el Primer Ministro, Erdogan.

Como me gusta que haya algún link a un periódico o noticia y el post no la trae, busco en el Google Reader. Y sí, es cierto: el partido AKP puede ser declarado ilegal según los Magistrados por it contra el laicismo del Estado turco. Y mi pregunta es: ¿no debiera haberse hecho antes de que se presentase a las elecciones? ¿Qué pasará si lo declaran ilegal? Hay que tener en cuenta que el Ejército es el garante de la laicidad en Turquía.

Lo que preocupa de las palabras de Erdogan, es que nada se ha decidido todavía: los jueces todavía tienen que decidir sobre la cuestión. Normalmente, el Primer Ministro (y los parlamentarios también) no comentan sobre los casos sin resolver, pero Erdogan tiene tanto miedo que no es capaz de callarse por un momento. Nuestros esfuerzos para asegurar la superioridad de la ley continuarán. Estamos llevando a la República turca en nuestros hombros como el gobierno de la ley democrática y secular. Vinimos para regir este país con nuestra líneas rojas y prometimos proteger las líneas de este país. Algunos hechos suceden hoy en nuestro país. Están intentando encerrarnos en la cuestión del velo.

El Fiscal General turco, ha dicho que el AKP está utilizando la democracia para introducir la Sharia, lo cual no sería ilógico considerando que Erdogan ya afirmó que la democracia era un autobús que les permitía llegar a un destino. Lo cual es verdaderamente preocupante, especialmente si le añadimos que también niega la eistencia de un Islam moderado, es más considera el término ofensivo.

Turkey’s highest court said Monday that it had decided to hear a case on shutting down the governing party and banning its political leaders, moving the country closer to a final confrontation between religious and secular Turks about who will rule the nation.

So, if the party is illegal, why wasn't it illegalised before being elected?

And we, have to consider that the Army is the guardian of the secular state. So what would happen in the case that the AKP is banned?

What's troubling about Erdogan's words is that nothing has been decided yet; the judges still have to decide upon the matter. Normally, the Prime Minister (and MPs by the way) don't comment on pending cases, but Erdogan is in such a great panic that he isn't able to keep his mouth shut for a while. In fact, today is the day that the court will decide whether it will take on the case or not. In other words, the court won’t decide today whether the AK Parti should be closed or not, it'll only decide whether it'll accept the case.

So what are those Erdogan's words about this matter?

Referring to the action to ban the party, Erdoğan stated: "this is a hesitant approach. History will never forgive this. Our efforts to ensure superiority of law will continue. We are carrying the Turkish Republic on our shoulders as a secular, democratic rule of law. We came to rule with our red lines and promised to protect the lines of this country. Certain events are going on in our country these days. They are trying to lock us into the issue of the headscarf."

"We came to rule with our red lines and promised to protect the lines of this country". And what if your red lines are different from the lines of his country?

It's curious that while Zapatero is hoping to impose laicism here, his first ally in the Alliance of Civilizations can be shut/ended because of wanting to end laicism in Turkey.

MEMRI said the demonstration, held in Sakarya, was organized by the Islamist Anatolia Youth Organization (AGD), with the support of other Islamist organizations.

During the demonstration, an Israeli flag with "Death to Israel" on it was burned and hateful speeches against Christian "Crusaders" and Jews, inciting the crowds to jihad, were delivered by Islamist activist Nureddin Sirin and by two AGD officials.

MEMRI noted that Turkish Prime Minister Tayyip Erdogan headed the AGD prior to becoming Istanbul's mayor.

Algunas de las pancartas decían, "Israel será destruido", "echaremos cuentas con el asesino Israel", "Si cada musulmán quita un cubo de agua, Israel se morirá de sed", "el camino de nuestros shahibs es nuestro camino".

MEMRI dijo que la manifestación, que tuvo lugar en Sakarya, fue organizada por la islamista "Organización joven de Anatolia", con el apoyo de otras organizaciones islamistas.

Durante la manifestación, una bandera de Israel con las palabras "Muerte a Israel" fue quemada y se pronunciaron discursos contra los cruzados cristianos y los judíos, incitando a las multitudes a la Jihad, por el activista islamista, Nureddin Sirin y por dos oficiales de la AGD.

MEMRI añadió que el Primer Ministro turco Erdogan fue el jefe de la AGD antes de ser Alcalde de Estambul.
